TERMS AND CONDITIONS FOR THE USE OF THE SERVICES AND PRODUCTS OF THE SCHOOL CATERING PLATFORM OF FURISTO LTD.


I. GENERAL PROVISIONS

  1. These Terms and Conditions (“Terms”) govern the relationship between Furisto Ltd., UIC: 200816906, with registered office and management address at: 7 Amsterdam Street, Sofia, Bulgaria, hereinafter referred to as the “PROVIDER”, and the individuals using the Platform, hereinafter referred to as the “USERS” (parents/guardians).
  2. Furisto Ltd. is the owner of an online school catering management platform accessible through a dedicated web address/subdomain for each individual educational institution (hereinafter referred to as the “Platform”).
  3. The Platform is accessible to all users (parents/guardians) whose children attend the respective school for which the specific section/subdomain of the Platform has been created.
  4. The Platform allows registration, ordering, and payment for meals via bank transfer or virtual POS terminal.
  5. By registering and using the services, the User declares that they are familiar with these Terms and Conditions and accepts them unconditionally.

II. REGISTRATION AND PROFILE

  1. Registration with a valid email address and password is required in order to use the services.
  2. The User is required to provide accurate personal information, including first and last name, contact phone number, and billing address.
  3. In their profile, the User adds their child/children by providing their names and corresponding class/group.

Note: Due to the specific structure of each school, the User selects the class/group from the predefined categorization available in the Platform for the respective educational institution.

​4.  accepting these Terms and Conditions, the User expressly consents to the processing of the provided personal data (both parent and child data) by Furisto Ltd. solely for the purposes of order processing, delivery, invoicing, and administration of the service, in accordance with GDPR requirements.


III. TERMS OF USE AND MENU

  1. Menu Preparation: Menus are prepared monthly by Furisto Ltd. in compliance with applicable regulations and recommendations and are coordinated with a medical professional and the management of the respective educational institution.
  2. The User is responsible for reviewing the current menu published on the Platform and assessing whether the ingredients are suitable for the child’s age and health condition.
  3. Service Content and Portions: The catering service includes a specific set of meals and corresponding portion sizes, which are described in detail in the “Menu” or “Info” section of the Platform for the respective school. By placing an order, the User confirms that they are familiar with and accept the parameters of the selected meal plan.
  4. Changes: In the event of unforeseen circumstances, Furisto Ltd. reserves the right to change the menu without prior notice while striving to maintain the nutritional value and quality of the meals.
  5. Allergies: When placing an order, the User is required to indicate any food allergies or intolerances. Furisto Ltd. provides meat/non-meat menu options or specially prepared meals according to the declared allergies.
  6. Preparation and Delivery: Depending on the catering organization of the respective educational institution, meals are either prepared on-site in the school cafeteria or delivered from the central kitchen of Furisto Ltd. in specialized thermal food containers. In both cases, the process complies with all applicable legal requirements and food safety and quality standards.
  7. Complaints regarding the quality or quantity of the meals are accepted only in written form via the email address specified in the Platform for the respective educational institution.

IV. ORDERS AND PERIODS

  1. Ordering periods (monthly, trimester, or annual) are determined individually according to the schedule of the respective school and are specified in the Platform.
  2. An order is considered accepted only after successful payment has been completed.
  3. Meal subscriptions may only be ordered within the deadlines specified in the Platform for the respective educational institution. After the announced deadline expires, the system automatically blocks new orders for the respective period.

V. PRICES AND PAYMENT METHODS

  1. All prices are listed in EUR, including VAT, and are displayed in the Platform for the respective educational institution.
  2. Individual Pricing: The prices of the offered services (meal subscriptions) are individually determined for each educational institution.
  3. Price Display: Current prices are clearly stated in the Platform and are displayed during the meal plan selection process.
  4. Payment Methods:

​4.1. Virtual POS Terminal

​Real-time payment by debit or credit card.

​4.2. Bank Transfer

​Payment via the bank account of Furisto Ltd. (with child’s name and subscription period specified in the payment reference).


​5. After successful payment, the User receives confirmation and an invoice by email.
Important: In the case of bank transfer, the order is activated/accepted only after the amount has been received in the Provider’s bank account.


​6. Invoicing: After the payment is reflected in the system, the User receives an electronic invoice to the registered email address, generated based on the billing information provided in their profile.


VI. CANCELLATION, WITHDRAWAL, AND REFUNDS

  1. In the event of a child’s absence, amounts for already paid services are deducted and transferred to a future period only if timely written notification is sent by email.
  2. The notification must be sent to the individual contact email address specified in the Platform for the respective educational institution. Notification deadlines may vary depending on the school.
  3. Refund Mechanism: Amounts for canceled orders are deducted from the next order placed through the Platform. If no subsequent order is placed or accepted (for example, if the service is discontinued), the amount is refunded to the User’s bank account according to the Provider’s conditions and after the required banking details are provided by the User.
  4. In the event of extraordinary circumstances (flu vacations, quarantines, emergencies, or other situations leading to school closure), the service is suspended. Paid amounts for the affected period are converted into credit for a future period.

VII. FINAL PROVISIONS

  1. Furisto Ltd. reserves the right to unilaterally amend and supplement these Terms and Conditions, with all changes being published in a timely manner on the Platform.
  2. In the event of non-compliance with these Terms and Conditions, Furisto Ltd. reserves the right to suspend the provision of services to the respective User.
  3. Furisto Ltd. shall not be liable for errors in orders caused by incorrectly entered information by the User or temporary technical interruptions of the Platform. In the event of a technical error in the displayed price, the Provider reserves the right to cancel the order and refund or deduct the respective amount to/from the User.
